Performance evaluation subjective discrimination exists when an employer’s subjective performance evaluations are used to practice unlawful discrimination. These are often used to circumvent the laws on the books by using extremely subjective criteria and lead to unfairn treatment.

Disability Discrimination
Disability discrimination exists when an employer treats a qualified individual with a disability who is an employee or applicant unfavorably solely because they have a disability.

Sexual Orientation Discrimination
Discrimination based on sexual orientation occurs when a qualified individual faces is treated unfairly due to their actual or perceived sexual orientation. Federal law does not explicitly prohibit workplace discrimination on this basis, but many states do. 

Racial Discrimination
Racial discrimination is a term that describes policies or habits of social discrimination against individuals based on their race. This includes missing out on a job opportunity due to one’s race. 

Pregnancy Discrimination
Pregnancy Discrimination is outlawed since the Pregnancy Discrimination Act of 1978, which disallows discrimination in the workplace on the basis of pregnancy or childbirth.
